These Terms of Service (“Terms”) govern your use of loanvouch.com and any related services (the “Service”) provided by LoanVouch (“LoanVouch”, “we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use the Service. By using the Service, you represent that you meet these requirements. The Service is not intended for users in jurisdictions where its use would be unlawful.
2. Account and use of the Service
Some features require a free account. You agree to:
- Provide accurate, current information when registering or applying.
- Maintain the security of your account credentials and notify us promptly of unauthorized access.
- Be responsible for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a risk to other users.
3. Reviews and user-submitted content
You may submit reviews, ratings, comments, and other content (“User Content”). By submitting User Content, you grant LoanVouch a worldwide, royalty-free, non-exclusive, transferable license to host, display, reproduce, adapt, and distribute that content in connection with the Service. You retain ownership of your content.
You represent that your User Content:
- Is your own honest opinion based on a real interaction or experience.
- Does not contain false statements of fact, defamatory material, or content that violates a third party’s rights.
- Does not include personal information of other people (full names, account numbers, etc.).
- Is not paid for by the company being reviewed or by a competitor.
We may edit, refuse, or remove User Content at our discretion, particularly if we believe it violates these Terms or our editorial policies.
4. Prohibited conduct
You agree not to:
- Submit fake, paid, incentivized, or coordinated reviews.
- Use the Service for unlawful purposes or to violate any applicable law.
- Scrape, crawl, or harvest data from the Service except as expressly permitted (e.g., via published APIs or RSS feeds with reasonable rate limits).
- Interfere with or disrupt the Service, attempt to gain unauthorized access, or probe for vulnerabilities without our written consent.
- Impersonate any person or entity, including lender representatives or LoanVouch staff.
- Upload viruses, malware, or other harmful code.
- Use the Service to spam, phish, or harass other users.
5. Loan applications and third-party lenders
LoanVouch is a review and matching platform — we are not a lender, broker, or fiduciary. Loans, credit decisions, and disbursements are made entirely by the third-party lenders listed on our site. We do not guarantee approval, specific terms, or any particular outcome.
When you submit an application through the Service, you authorize us to transmit your information to the lender(s) you select. Your relationship with the lender is governed by the lender’s own terms, privacy policy, and loan agreement. Read those documents carefully before signing anything.
We do not provide financial, legal, or tax advice. Information on the Service is for general informational purposes and should not be relied upon as professional advice for your specific situation.
6. Intellectual property
The Service, including its design, code, text (other than User Content), graphics, and trademarks, is owned by LoanVouch or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, or distribute this material except as permitted by these Terms or applicable law.
Company logos and trade names belonging to lenders displayed on the Service are the property of their respective owners and are used for identification purposes under fair-use principles.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION ON THE SERVICE IS ACCURATE OR COMPLETE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOANVOUCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless LoanVouch from any claim, damage, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any law.
10. Dispute resolution
We prefer to resolve disputes informally. Before filing a formal claim, please contact us at [email protected] so we can try to work it out. If we cannot resolve it within 30 days, any dispute arising out of or related to these Terms or the Service will be resolved through binding individual arbitration, except either party may bring a claim in small-claims court. You and LoanVouch agree to waive any right to a jury trial and to participate in any class or representative action.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The exclusive venue for any non-arbitrable dispute is the state or federal courts located in Wilmington, Delaware, and you consent to that jurisdiction.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason — including violation of these Terms. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability limits, dispute resolution, governing law) will survive.
13. Changes to these Terms
We may update these Terms from time to time. For material changes we will post the new effective date and may notify users via email or a site banner. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Miscellaneous
These Terms are the entire agreement between you and LoanVouch regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms; we may assign them to a successor entity.
